1. Definitions

In these General Terms and Conditions, the following definitions apply:

• JeOfferte.nl: JeOfferte.nl B.V., having its registered office at Keizersgracht 520 H, 1017 EK Amsterdam.
• Consumer: any natural person who is not acting in the course of a profession or business and who uses the services of JeOfferte.nl.
• Service Provider: a third party who, through the platform, comes into contact with consumers and may issue quotes.
• Platform: the website www.jeofferte.nl and related digital services.
• Quote Request: a request submitted by the consumer through the platform to come into contact with one or more service providers.
• Third-party content: data, links or information originating from external parties for which JeOfferte.nl bears no responsibility.
• Distance contract: a contract concluded between a consumer and a service provider without the simultaneous physical presence of the parties.

2. Applicability

These General Terms and Conditions apply to every visit to, and use of, the JeOfferte.nl platform. By using the platform, the consumer declares to have read and accepted these terms and conditions. Deviations are only valid if confirmed in writing by JeOfferte.nl.

3. JeOfferte.nl's services

JeOfferte.nl provides a digital intermediary platform on which consumers can make their requirements known and professional service providers can issue quotes. JeOfferte.nl is not itself a contractor, installer or executor of works. The ultimate agreement is concluded exclusively between the consumer and the service provider.

4. Use of the platform

1. The consumer is responsible for providing correct, up-to-date and complete information. It is not permitted to use the platform for incorrect, misleading or fraudulent requests.
2. JeOfferte.nl reserves the right to refuse requests and to suspend or delete accounts in the event of suspected misuse, incorrect data or breach of these terms and conditions.
3. The platform may not be used for commercial purposes without the prior written consent of JeOfferte.nl.

5. Quote requests and contact

After a request has been submitted, JeOfferte.nl may forward the data to selected service providers. JeOfferte.nl does not guarantee that quotes will always be issued or that they will meet the consumer's expectations. All arrangements, prices and works are agreed directly between the consumer and the service provider. JeOfferte.nl is not a party to the agreement.

6. Role of JeOfferte.nl

1. JeOfferte.nl acts solely as an intermediary and bears no responsibility for the quality, accuracy, timeliness or performance of services rendered by third parties.
2. JeOfferte.nl is not obliged to verify the identity, licences or qualifications of service providers and accepts no liability for the acts or omissions of third parties.

7. Fees and costs

Use of JeOfferte.nl is free of charge for consumers. Should fees be attached to additional features or services in the future, this will be clearly stated in advance.

8. Liability

1. JeOfferte.nl is not liable for any damage, whether direct or indirect, arising from the use of the platform, including loss of profit, data loss, reputational damage, malfunctions or damage caused by third parties.
2. JeOfferte.nl does not warrant that the platform will operate uninterrupted or error-free and is not liable for damage to users' equipment, software or data.
3. Any liability of JeOfferte.nl shall at all times be limited to the amount paid out by its liability insurance or, failing that, to €100 per event.

9. Intellectual property

1. All intellectual property rights relating to the content of the platform, including software, texts, images, logos and databases, vest in JeOfferte.nl or its licensors.
2. It is not permitted to copy, scrape, reproduce or publish material from JeOfferte.nl without written consent.

10. Reviews and user content

1. Consumers may post reviews or ratings. JeOfferte.nl reserves the right to monitor, refuse or remove these in the event of misuse, untruths or inappropriate content.
2. JeOfferte.nl may use published reviews in anonymised form in marketing materials, advertisements and publications.
3. The user is responsible for the content of their review and indemnifies JeOfferte.nl against third-party claims.

11. Privacy

JeOfferte.nl processes personal data in accordance with applicable legislation (GDPR). Please consult the privacy statement for further information on processing, purposes and rights.

12. Force majeure

Force majeure shall include: disruptions to internet connections, power outages, cyberattacks, pandemics, government measures, natural disasters and other circumstances beyond the control of JeOfferte.nl. In the event of force majeure, JeOfferte.nl is not obliged to fulfil any obligation.

13. Electronic communication and evidence

All electronic communications, system logs and data of JeOfferte.nl shall constitute full evidence of use and communication between the parties, subject to evidence to the contrary.

14. Amendments and continuity

JeOfferte.nl may amend, extend or discontinue its services, terms and functionalities, provided that reasonable notice is given. These terms supersede all previous versions.

15. Applicable law and disputes

These terms and conditions are governed exclusively by Dutch law. Disputes shall preferably be resolved amicably. Consumers also have the option to submit a dispute via the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr. Competent court: Amsterdam.

16. Final provisions

If any provision proves to be invalid, the remaining provisions shall remain in full force and effect. These terms and conditions shall enter into force on the date of publication and may be updated without prior notice.
